Directorate of Enforcement is a Multi-Disciplinary Organization mandated with the task of enforcing the provisions of two special fiscal laws -

1. Foreign Exchange Management Act, 1999 (FEMA)

2. Prevention of Money Laundering Act, 2002 (PMLA)

Enforcement Directorate besides directly recruiting personnel, the Directorate also draws officers from different Investigating Agencies, viz., Customs & Central Excise, Income Tax, Police, CBI, etc. on deputation. (See Deputation Adv. for reference)

“para 7.15.24 – The posts of Assistant Enforcement Officer and Chief Enforcement Officer (Now redesgnated as Assistant Director) have traditionally been on par with the posts of Income Tax Inspectors and ITO/analogous posts in CBDT and CBEC. Subsequent to up-gradation of posts of Inspectors/ITOs/analogous posts in CBDT and CBEC, the Government also upgraded the posts in Enforcement Directorate but with a time lag. Since the parity between these posts is well established, the Commission recommends that the same should be maintained in future.”

Job Description

The work of Assistant Enforcement Officer (AEO) depends on the seat and place of posting. Metropolitan cities like Delhi, Mumbai, Chennai have higher chances of FEMA or PMLA Offences and hence AEO gets the chance to be in field but in cities like Allahabad, Raipur, etc AEO have to do clerical tasks.

Duties to Perform 

  • To collect, develop and disseminate intelligence relating to violations of FEMA, 1999, the intelligence inputs are received from various sources such as Central and State Intelligence agencies, complaints etc.
  • To investigate suspected violations of the provisions of the FEMA, 1999 relating to activities such as “hawala” foreign exchange racketeering, non-realization of export proceeds, non-repatriation of foreign exchange and other forms of violations under FEMA, 1999.
  • To adjudicate cases of violations of the erstwhile FERA, 1973 and FEMA, 1999.
  • To realize penalties imposed on conclusion of adjudication proceedings.
  • To handle adjudication, appeals and prosecution cases under the erstwhile FERA, 1973
  • To process and recommend cases for preventive detention under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act (COFEPOSA)
  • To undertake survey, search, seizure, arrest, prosecution action etc. against offender of PMLA offence.
  • To provide and seek mutual legal assistance to/from contracting states in respect of attachment/confiscation of proceeds of crime as well as in respect of transfer of accused persons under PMLA.

This shows how much staff crunch in Enforcement Directorate only 33% of sanctioned strength is present and hence resulting in enormous workload at each level.

Excerpt from a leading news paper

"An internal assessment of the Enforcement Directorate (ED), which handles all PMLA cases, shows that its investigating officers achieved an average disposal rate of just 1.4 cases dur ing 2013-14. And the pendency of PMLA cases per officer was a staggering 7.7.

If the existing number of investigating officers were to complete the PMLA cases, it would take 5.5 years. The delay in ED is caused by huge shortage of manpower, with the agency running with just 33% of the sanctioned strength. Out of a sanctioned strength of 2064, it has just 686 employees. It is also facing a fresh exodus of officials on deputation in recent months. [/quote]


   The Staff crunch in ED is self explanatory about the promotion aspects in the department. Smaller cadre, 33% of sanctioned strength is working, which means ample of opportunity to get promotion on time.  An AEO can get promoted to EO in 5 years maximum.  An EO after 4 years of further service gets promoted to Assistant Director (In ITI, Excise, PO, Examiner the designation remains same at this level of promotion). An Assistant Director of ED gets promoted to Dy. Director in minimum 3 years and maximum 5 years. So, practically ED has the fastest promotion among all other departments. So, an AEO joining at age of 22-25 can reach up to the level of special Director in ED  * Remember Deputation Officers are there but only for 3 years Maximum. Hence, the Permanent employees of ED have significant chances of growth in terms of promotion.


Transfers are frequent but as mentioned above the offices are in limited numbers and are located in national & state capitals. So, one should not afraid of the transfers. 


ED deals with the cases which involves huge amount of money and powerful peoples, So an AEO being the lowest group B officer in the office will not have authority or power to deal such cases. Money is there but it flows from top to down.

Moreover, cities like Allahabad, Ranchi, Raipur, etc are said to be dry in terms of money.
